A Tasmanian industrial dispute worker's claim that federal legislation was gutted after Labor's failure to pass laws targeting paid leave was the subject of a workplace action against his former employer by Labor yesterday.
In a statement, the industrial dispute resolution body said the union was alleging unfair dismissal.
But the Victorian Labor Government has yet to formally respond.
Labor's bill to legislate against unpaid leave has met fierce opposition from union officials as well as members.
In its first public intervention, the Victorian government announced it was dropping a request to intervene as the industrial dispute resolution body (IACRB) is reviewing the legislation.
"While I understand that the Victorian government has decided to drop its request, it still remains our understanding that these provisions must be taken into account in any future discussion between the Government and the IACRB," the Victorian Labor government said.
In a statement, a Department of Work Safety spokesperson said the legislation passed after a "dramatic and highly contested hearing" in February 2015 was largely unaffected.
"It was a matter for the Victorian Workplace Relations Act 2012 as amended in 2013," the statement said.
"An important outcome of the hearing was that the legislation complied with relevant legislation that the Australian Labor Party (ALP) has a commitment to seek to amend in the future."
The IACRB has previously ruled on workers' claims against employers for allegedly failing to pay workers for unpaid leave.
The IACRB has a history of taking workers to Court to determine whether an employer breached workers' rights during the course of an industrial dispute.
It has already ruled on a number of industrial disputes over unpaid leave.
The Victorian legislation to regulate workplace safety also received widespread criticism last year after more than 600 workers and former management and members took the Court of Arbitration for Sport to challenge safety conditions.
The Workers' Compensation Board also struck a blow to union members last year when it ruled a workers' strike threatened the welfare and future of union members.

Women survive deadly box jellyfish attack in New Zealand

Some New Zealanders managed to survive a deadly jellyfish attack during the weekend but most survived despite wearing life-rafts.
Annette Smith says her three children slept through their first night back in Auckland after returning from holiday in Fiji.
"They've been out here, and they've seen some weird things and this one just kept coming and coming and coming. They're just screaming."
"I put my kids up, and they went into the bedroom and there's no doors.
"We had to turn on the light because there was no light."
Despite the initial horror and the horror of seeing her children covered in what they say could have been blood, they decided to stay the night.
Ms Smith is now wondering how many of them, if any, escaped with injuries.
"It's a little bit like a family thing, we all look after each other and you just feel sorry for the little girl who might have had that kind of reaction to what was going on and she wasn't able to help her," she said.
The men spent the night at the police station but were released.
The incident is currently being investigated by the New Zealand Police Force and police are urging people to report any similar incidents to their Local Area Command office on 123 896.

In a separate article, The Financial Review is quoted as saying that there are about 40 "hollow-brick examples of companies like Asix that defraud superannuation companies for years to come".
Meanwhile in the Australian Financial Review, Mark McGeachan says that "At every stage of the financial crisis, superannuation companies have made money on the backs of the superannuation fund, either selling them or buying them back".
The story further says that former Labor treasurer Kevin Rudd's first year in office was plagued by "hollow-brick examples of companies like ASX in Australia selling up", and that Rudd "was caught red handed twice by ASX" and in 2011 was also criticised as an "elitist".
As for John Quiggin, it is his paper that has apparently failed to "understand it's financial nature" and that it can "rein in the banks if necessary", which makes me wonder whether this reporter is not a financial journalist or indeed an expert on economics and finance?
And how can such an article be printed by a daily newspaper in New Zealand, with its relatively small staff, be labelled "saying nothing" of note, or what does this even mean exactly. It is all rather suspicious. The fact that "noone in politics has dared to call the ASX cheats cheats" suggests that the publication is not bothered by controversy, or that the idea is not to speak up?
The piece also says: "But what makes this article significant is its title: WPP has burnt its superannuation fund, and so, after paying off creditors, it now finds it hard to collect any of the $1.3bn it has to pay off their debts in 2012."
